Article VI: Vacancies

Section 1: Occurrence

VI.1.00 Any ASCWI government position may be vacated, either voluntarily or involuntarily in the following ways:

VI.1.00.01 Members are removed from office; or 

VI.1.00.02 Members are no longer a member of the ASCWI; or

VI.1.00.03 Members become unable to perform their duties and surrender their position; or

VI.1.00.04 Members resign from office.

Section 2: Order of Presidential Succession

VI.2.00 In the event that the president is resigned, removed, or otherwise unable to fulfill the duties of the office, the vacancy shall be filled by the vice presidents in the following order:

VI.2.00.01 Vice president of student life

VI.2.00.02 Vice president of student resources

VI.2.00.03 Vice president of records and finance

Section 3: Internal Vacancies & Interim Chairs

VI.3.00 To ensure no committee or executive function remains stagnant during a vacancy; the following procedures apply:

VI.3.00.01 In the absence of an appointed council ,member to chair a specific committee, the overseeing vice president shall serve as the interim chair and assume all responsibilities of that committee until a permanent appointment is made.

VI.3.00.02 The vice president of student life shall chair Events and Programming, Student Service, and Online Engagement and Outreach.

VI.3.00.03 The vice president of student resources shall chair Club Recognition and Support and Community Service and Civic Engagement.

VI.3.00.04 A vice president serving as an interim chair retains their executive voting rights but does not receive additional votes for the committee chair position.

Section 4: Extraordinary Vacancies & Administrative Intervention

VI.4.00 While ASCWI is a student-led body, a "loss of quorum" threshold is established to protect the interests of the student voice during extreme turnover.

VI.4.00.01 If at any point the number of vacant elected officer positions exceeds 50% of the total elected board, the organization shall be deemed in a state of "emergency vacancy."

VI.4.00.02 Upon reaching this threshold, the dean of students is authorized to implement an interim plan for Student Engagement.

VI.4.00.03 This administrative oversight is strictly intended to support the identification, recruitment, and vetting of new student leaders to fill open ASCWI roles and restore the student government to full functionality.

Section 5: Appointment Process for Vacant Vice President Roles

VI.5.00 If a vice presidency becomes vacant and the 50% threshold has not been met:

VI.5.00.01 The president shall screen and nominate a candidate from the current council or the general student body.

VI.5.00.02 The candidate must be confirmed by a two-thirds majority vote of the remaining seated ASCWI officers.

VI.5.00.03 The newly appointed vice president will serve the remainder of the original term.

Section 6: Council Member Vacancy

VI.6.00 In the event of a council member position becomes vacant, and the 50% emergency vacancy threshold has not been met, the position shall be filled using the following procedure:

VI.6.00.01 The vice president of student life or vice president of student resources shall screen and nominate a qualified candidate from the general
student body or the broader student organization.

VI.6.00.02 The nominee must be confirmed by a supermajority (two-thirds) vote of the ASCWI Executive Council.

VI.6.00.03 The newly appointed council member will serve the remainder of the current term.

Section 7: Movement Within ASCWI Government

VI.7.00 To maintain continuity and structural integrity when an active leader changes roles within the government, the following rules apply:

VI.7.00.01 If a currently seated ASCWI government member is appointed to fill a vacancy, that member has exactly 48 hours to accept or decline the appointment.

VI.7.00.02 An active student government member may be considered and appointed for a different position within ASCWI without being required to resign from their current position prior to the appointment process.

VI.7.00.02 Upon formal confirmation by the ASCWI Executive Council to the new position, the member shall automatically and immediately be removed from his or her original position.

Section 8: Multiple Government Positions

VI.8.00 To ensure fair representation and balanced workloads, strict limits are placed on holding concurrent titles:

VI.8.00.01 No elected or appointed member of the ASCWI government should hold more than one position simultaneously.

VI.8.00.02 The appointment of a current ASCWI government member to a different position shall be governed by section 7 of this article and shall not be considered a violation of this section, provided the member’s former position is vacated immediately upon confirmation to the new position.

VI.8.00.03 This section does not conflict with the temporary, non-voting “dual roles” assigned to vice presidents serving as interim chair under section 3 of this article.
